NICE CXone “Digital Makeover: Contact Center Edition” Contest Description and Terms and Conditions

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1) Eligibility. This Digital Makeover: Contact Center Edition Contest (“Contest”) is open to United States-based non-governmental businesses, across any industry and non-governmental education institutions, which are not current customers of inContact or its affiliates. The following individuals are not eligible to participate in the Contest (“Ineligible Individuals”): (a) employees of inContact, Inc. (“inContact”), its affiliates, and any advertising, promotion and other suppliers engaged by inContact, and immediate family members and/or those living in the same household of such employees; and (b) employees or internally contracted vendors of governments and government-affiliated companies. The Contest is subject to all applicable federal, state, and local laws and regulations, and void where prohibited by law.

2) Agreement to Rules. By participating in the Contest, you agree to be fully and unconditionally bound by these terms and conditions, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the decisions of inContact as final and binding as it relates to this Contest.

3) Contest Period. Entries will be accepted online starting at 12:00 PM MST on June 1, 2022 and ending at 11:59 AM MST on August 31, 2022.

4) Registration. You must fulfill all Contest requirements, as specified herein, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of inContact. 5) Prizes. inContact will provide the grand prize winner with a grand prize valued at $160,000. The grand prize consists of up to $125,000 of inContact software offerings (excluding any software offering that is not proprietary to inContact) selected by the winner of the contest, plus 7 exclusive sessions with Jeannie Walters with Experience Investigators, including a virtual keynote with the team. The 7 exclusive sessions consist of the following:

a. Kick-off Workshop

  • entailing First month coaching virtual kick off workshop (up to 5 people at winner’s company)
  • Includes live participation by Jeannie Walters

b. Five Monthly Coaching Meetings

  • 5 months following kick off workshop of 1 hour coaching meetings (monthly basis)

c. Two Quarterly Coaching Meetings

  • 2 quarters of 1 hour consulting meetings

inContact will provide the first runner up winner with 5 exclusive sessions with a certified coach from Experience Investigators valued at $27,000. This prize includes:

a. Kick-off Workshop

  • First month coaching virtual kick off workshop (up to 5 people at winner’s company)
  • Includes live participation by Jeannie Walters

b. Five Monthly Coaching Meetings

  • 5 months following kick off workshop of 1 hour coaching meetings (monthly basis). Led by a certified coach from the Experience Investigators Team with oversight by Jeannie Walters.

If a contact center agent submits an entry form on behalf of their company, and the company accepts the grand prize or first runner up prize, the agent will be eligible to receive a $200 Amazon gift card. Agent eligibility to receive the gift card is subject to all applicable laws, and any rules and regulations of the company (i.e., their employer) relevant to accepting the gift card.

Prizes are nontransferable. All prize-related expenses, including, without limitation all federal, state, and/or local taxes, shall be the sole responsibility of Contest winners. Acceptance of a prize constitutes permission for inContact to use the winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

6) Winner Notification. Winners will be notified by email used when entering the contest by October 18, 2022. The top 10 contestants (as scored by the Contest judges) will be notified on or before October 3, 2022 to ensure that (a) their contact center decision makers and stakeholders are aware of having been selected in the top 10 list; and (b) they are able to accept the grand prize or runner up prize if chosen as the Contest winner or runner up. inContact shall have no liability for any prize winner’s failure to receive notices due to spam, junk e-mail or other security settings or for a prize winner’s provision of incorrect or otherwise non-functioning contact information. If a prize winner cannot be contacted, is determined to be an Ineligible Individual, or fails to claim the prize within 5 business days from the time the prize notification is sent, the prize will be forfeited, and an alternate prize winner selected. Receipt by a winner of the prize offered in this Contest is conditioned upon compliance with all federal, state, and local laws and regulations. Any violation of these contest terms and conditions by a prize winner will result in disqualification from the contest.

7) Terms & Conditions: inContact reserves the right, in its sole discretion, and at any time to cancel, terminate, modify or suspend the Contest. In such case, inContact may select the prize winners from all eligible entries received prior to and/or after (if appropriate) the action taken by inContact.

8) Limitation of Liability: By entering the Contest, you agree to release and hold harmless inContact and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof.

9) Disputes: THIS Contest IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE STATE OF UTAH, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Salt Lake City, Utah having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.
